Judges are there to judge.a0 They are not there to make law, or as we say in the US: legislating from the bench .a0 The law IS the law, and the judge made the jumegdent that the complainant, under the provisions OD that law, was harmed.a0 It is not up to the judge to decide the merits of the law, only that the law itself was indeed violated. If this sort of thing went to a jury here in the US, the jury could in fact find the airline blameless based on their belief that the law itself was not valid or did not apply.a0 This is called jury nullification. Canada is a bilingual country and has this law in place.a0 The fact that the complainant is fluent in both languages but still chose to file the complaint means but one thing: he is either a sniveling little crybaby; he is a lawyer and makes trouble where he can by using the law as a plaything; or he relishes every single ounce (sorry, gram) of control over others that he can muster in his drab, wretched life as a bureaucrat.a0 We have that kind down here in the US and don't like them any better than you folks up north.
